Terms of service
Effective September 15, 2026.
These terms are between Rad Soft, Inc. ("Harkly", "we") and you, the person or company creating a Harkly workspace. Self-hosting the open-source software is governed by the AGPL-3.0 license in the repository, not by these terms.
The service
Harkly Cloud is the hosted version of the product: the dashboard at
app.harkly.app, the portals we host at *.harkly.app and on your domains,
the API, and the SDKs. We will run it with reasonable care and skill and
keep it available except for planned maintenance we announce and events
outside our control.
Your account
You are responsible for what happens under your workspace: keeping your sign-in email secure, the people you invite, the keys you create, and the content your team and your customers put in. Tell us at security@harkly.app if you think an account was compromised.
Acceptable use
Don't use Harkly to send spam, to harass anyone, to collect data you have no right to, to break the law, or to attack the service or other tenants. Don't resell it as your own product without an agreement with us. We may suspend a workspace that does, and we will tell you why.
Your content
It stays yours. You give us the license we need to host, display and process it to run the service and nothing more. You are responsible for having the right to put it in, including your customers' personal data, which we process under the DPA.
Fees
Paid plans are billed by Stripe in advance, monthly or yearly, at the prices shown at /pricing when you subscribe. Price changes take effect at your next renewal with 30 days' notice. You can cancel any time; the plan runs to the end of the paid period and there are no refunds for partial periods, except where the law requires them.
Termination
You can delete your workspace whenever you like. We can end the agreement with 30 days' notice, or immediately for a material breach that isn't cured after we point it out. After termination we delete your data on the schedule in the DPA and you can export it first.
Warranties and liability
The service is provided as is. To the extent the law allows, neither party is liable for indirect or consequential loss, and our total liability in any twelve months is limited to the fees you paid us in that period. Nothing limits liability for fraud, death or personal injury, or anything that can't be limited by law.
Changes
We may update these terms; material changes are emailed to workspace owners 30 days before they apply. Continued use after that is acceptance.
Law
Texas law and the courts of Texas, unless a mandatory consumer law where you live says otherwise.
